I incorrectly wrote that the zoning for downtown commercial regulated the total number of formula restaurants. Benicia Municipal Code, Title 17 and section 17.70.350 regulates the number of the SAME formula restaurants not the total number. The good news, I suppose, is that there can be only one of each of the over 6,000 formula restaurants in the US and Canada in Benicia's downtown.

Secondly, it appears that I may have given the wrong impression on the way the agenda is sent by the city. Here is the way it works as I understand it: each city department has an e-list for notices and agendas. The notices and agendas are emailed to this list and I forward this email to my e-list. Each department has their way of sending emails. I noted below in the original email that the "labeling" was an internal code - I did so in order to explain why the pdf document was labeled without a name. Staff has forwarded the Planning Commission agenda below. The last of the formula restaurant business allowed in the downtown is being considered. This is the last one that can be added since there is a quota on such formula restaurants. The downtown area includes Solano Square, Davies Square and First Street.

Another item is the transferring of design review of multifamily and commercial OUTSIDE the historic districts to the Planning Commission. This will provide for the Historic Preservation Review Commission's focus on historic design review for structures in the historic districts. Staff will be working with the Planning Commission on training and skills for their new design review duties if the council ultimately agrees to the zoning text changes.

The labeling of the pdf document below is an internal control number. I believe this will be corrected in the future so the labeling is the actual title of the document. All staff reports for the Agenda items are posted on the city's webpage.
